Details of Accident : Claimant was a pedestrian that was waiting at a traffic island. A city bus had overtaken a road sweeper, and proceeded to drive on the wrong side of the road. The bus driver negligently failed to use higher duty of care, and knocked the Claimant down with the bus causing personal injuries.
Injuries Sustained : Claimant sustained injury to spine, minor head injury and mixed anxiety and depression as a result of this accident.
Resolution : A deputy District Judge determined the bus driver was 70% negligent for the accident. Based on the medical report and schedule of specials, the Judge awarded damages in the amount of £11,000, to be reduced by Claimant’s 30% negligence.
