When you are a victim in a car accident and are struck from behind, an injury from whiplash is almost a certainty. You may not feel that pain right away because symptoms may not show up until you have had time to relax. The best thing you can do for whiplash is to visit your Doctor as soon as possible after the accident.
You will also probably attempt to call the other driver’s insurance company. That’s a natural reaction to an accident. They are not going to be helpful, even if they sound like they want to do what is best. Their job is to pay as little as possible for compensation.
Never accept the name of a solicitor from an insurance company. They are going to make sure you see a solicitor that will go easy on them with your injury from whiplash claim. Do not be fooled into believing you must see their doctors or their solicitors. You have every right to choose your own doctor, and to get the best Solicitor to help you with the claim.
Beware of any claims manager that an insurance company may “suggest” to help you with your claim. Claim managers hired by insurance companies will direct your case to a solicitor that is also of the insurance company’s choosing for your case.
You should never pay a fee, or be responsible for any representation bills unless your injury from whiplash case is resolved successfully. When you choose a Solicitor to represent you, ask them important questions such as:
- Do you collect a fee if I don’t win my case?
- How many whiplash cases have you successfully handled?
- How much have you earned in settlements for your clients?
- How can you help me get my life restarted during my claim?
- How long will my claim take?
- How much compensation can I expect from my case?
Specific information on your particular case will vary, and your Solicitor should take as much information as necessary to come up with the estimates. Remember that settlement claims depend on many different variables, so any quote your Solicitor will give you is bound to be a rough estimate. However, an experienced Solicitor will be able to look at your information and make a reasonable estimate.
The time a case will take depends more on the insurance company than the solicitor. The Solicitor will have very little control over how much time it takes the insurance company to come back with a settlement figure for your whiplash.
